Senior Peace Care may provide information about, refer members to, identify, locate, or facilitate communication with independent third-party businesses and service providers ("Third-Party Providers").
Third-Party Providers may include independent contractors, businesses, transportation providers, home-service companies, repair companies, healthcare-related organizations, professional service providers, community organizations, and other businesses.
Senior Peace Care is not a party to the agreement, transaction, relationship, or arrangement between a member and a Third-Party Provider.
Any service purchased, requested, scheduled, performed, or received from a Third-Party Provider is provided directly by that Third-Party Provider.

Unless Senior Peace Care expressly states otherwise for a particular service, Senior Peace Care does not represent that it has:

Senior Peace Care may use third-party directories, search engines, business listings, maps, review platforms, websites, databases, advertisements, and other publicly available sources when assisting members.

A provider's appearance in a search result, directory, map, website, or other source should not be interpreted as an endorsement by Senior Peace Care.
When a member asks Senior Peace Care to contact a Third-Party Provider on the member's behalf, the member authorizes Senior Peace Care to communicate information reasonably necessary to fulfill that request.

Once a member begins communicating directly with a Third-Party Provider, Senior Peace Care generally has no control over:

Any transaction between a member and a Third-Party Provider is a transaction between those parties.

Senior Peace Care is not a medical provider, law firm, financial institution, financial advisor, insurance company, emergency-response organization, or other professional advisory organization unless expressly stated otherwise.
Our assistance in locating a professional or service provider does not constitute:

Senior Peace Care attempts to provide concierge assistance to members in a reasonable manner.
However, we do not guarantee that:
Our obligation is limited to providing reasonable assistance within the scope of the membership and our operational capabilities.
Members may contact Senior Peace Care using the telephone number provided on the Website or through their membership information.
We endeavor to answer member calls and provide assistance.
However, telephone availability may be affected by circumstances including:

A missed, dropped, delayed, unanswered, misrouted, or unsuccessful call does not by itself constitute a breach of these Terms.

It should not be understood as a guaranteed 24/7 emergency hotline, guaranteed live-answer service, or emergency-response number unless the Website expressly states otherwise.
Members should use appropriate emergency services when immediate assistance is required.
The Website, telephone systems, membership systems, payment systems, databases, email systems, and other technology may occasionally become unavailable.

Senior Peace Care may offer a recurring membership for a fee of $9.99 per month, unless another price is clearly disclosed at the time of enrollment.

Membership does not guarantee a particular number of successful provider referrals, calls answered, tasks completed, or outcomes achieved.
By enrolling in a recurring Senior Peace Care membership, you authorize Senior Peace Care and/or its authorized payment processor to charge the payment method you provide for the applicable membership fee on a recurring basis until you cancel or your membership is otherwise terminated.
The recurring nature of the membership, applicable price, billing frequency, and cancellation method should be clearly disclosed at enrollment.
Where required by law, Senior Peace Care will obtain appropriate consumer consent and retain appropriate records of that consent.
Federal consumer-protection rules concerning recurring subscriptions emphasize clear disclosure of material terms and an effective cancellation mechanism.
Members may cancel their membership using the cancellation method provided by Senior Peace Care.
Cancellation should be reasonably simple and should not require a member to continue accepting unwanted services.
Where applicable law requires a particular cancellation method or procedure, Senior Peace Care will comply with that requirement.
After cancellation, recurring membership charges should stop in accordance with the applicable cancellation terms and law.
Membership fees already properly charged may be non-refundable unless otherwise required by applicable law or expressly stated by Senior Peace Care.

Consumers may request that Senior Peace Care stop making marketing or telemarketing calls to them.
An entity-specific Do-Not-Call request will be honored in accordance with applicable law.
Where applicable, Senior Peace Care may also maintain internal Do-Not-Call procedures and use applicable National Do Not Call Registry information.
The National Do Not Call Registry is administered by the FTC and is enforced by federal and state authorities.
A request to stop marketing calls does not necessarily prevent non-marketing communications that are necessary to administer an existing membership or respond to a member's requested service, to the extent permitted by law.
When a member voluntarily calls Senior Peace Care to request assistance, the call is treated as a customer-initiated service interaction.
A member may subsequently receive communications reasonably necessary to respond to or fulfill that request, subject to applicable law.
Marketing communications are separately subject to applicable consent and communication requirements.
Senior Peace Care will not rely on these Terms alone as a substitute for any legally required consent for autodialed calls, prerecorded voice calls, artificial-voice calls, or marketing text messages.
Where applicable law requires prior express consent, prior express written consent, or another form of consent, Senior Peace Care intends to obtain and maintain the applicable consent.
Consent may be withdrawn as permitted by law.

Senior Peace Care may decline requests where it reasonably believes that the requester lacks appropriate authority.
Senior Peace Care recognizes that some members may be older adults or otherwise vulnerable individuals.
However, Senior Peace Care is not a substitute for:

Senior Peace Care does not assume custody, guardianship, supervision, or responsibility for the physical safety of any member merely because the member uses the Services.

If a provider requests unusual payment methods, gift cards, cryptocurrency, account credentials, remote computer access, or other suspicious information, members should independently investigate before proceeding.
Senior Peace Care does not guarantee the absence of fraudulent or dishonest Third-Party Providers.
The Website or Services may reference or link to third-party websites, directories, search engines, maps, review platforms, social media platforms, or other resources.
These third-party services are independent of Senior Peace Care.
Senior Peace Care does not control:

Senior Peace Care may encounter ratings, reviews, recommendations, or other information about providers through third-party websites.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENIOR PEACE CARE AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, TECHNOLOGY PROVIDERS, AND SERVICE PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO:
EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SENIOR PEACE CARE ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT THE MEMBER ACTUALLY PAID TO SENIOR PEACE CARE FOR THE SERVICES DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(B) ONE HUNDRED DOLLARS ($100).
This limitation applies to the maximum extent permitted by applicable law.
Where a state law prohibits a particular limitation, the limitation shall be modified only to the minimum extent necessary to comply with that law.
To the maximum extent permitted by law, Senior Peace Care is not responsible for claims arising solely from the conduct, acts, omissions, negligence, misconduct, representations, services, products, pricing, or contractual relationship of a Third-Party Provider.
A member's dispute with a provider should ordinarily be directed to that provider.
Nothing in this section prevents a member from asserting a claim against Senior Peace Care that cannot legally be waived.
To the maximum extent permitted by law, members release Senior Peace Care from claims arising solely from the acts or omissions of Third-Party Providers contacted, identified, or referred through the Services.
This release does not apply to liability that cannot legally be released.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Senior Peace Care and its owners, officers, directors, employees, contractors, affiliates, agents, and service providers from claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising out of:

The arbitration provision will not apply where applicable law prohibits mandatory arbitration or requires a consumer dispute to remain in court.
Nothing in this provision is intended to waive rights that cannot legally be waived.
The final published version should identify the arbitration administrator, applicable rules, procedures, location, cost allocation, and process for initiating arbitration.
To the maximum extent permitted by applicable law, disputes subject to arbitration shall be brought only on an individual basis and not as a class, collective, consolidated, or representative action.

If there is a conflict between these Terms and a specific written service agreement, the specific agreement may control to the extent expressly stated.
Using Senior Peace Care does not create an employment, agency, partnership, joint venture, franchise, fiduciary, or contractor relationship between Senior Peace Care and a Third-Party Provider.
Senior Peace Care does not employ Third-Party Providers merely because it identifies or refers them to members.
Except where expressly stated in writing, Senior Peace Care is not the legal agent of a member.
When Senior Peace Care contacts a Third-Party Provider at a member's request, it is performing a limited concierge/communication function and does not have authority to enter a contract, authorize work, approve pricing, make payments, or otherwise legally bind the member unless specifically authorized.
Unless expressly disclosed otherwise, members are responsible for paying Third-Party Providers directly.
Senior Peace Care does not guarantee provider pricing, payment methods, refunds, warranties, or billing practices.
If Senior Peace Care introduces a provider, that does not mean Senior Peace Care has accepted financial responsibility for the provider's services.
Senior Peace Care is not an insurance company and the membership is not an insurance policy.
The $9.99 monthly membership does not provide insurance coverage for:

The member remains responsible for determining whether a service provider is suitable.
Members should not rely solely on Senior Peace Care's identification of a provider when making important decisions.
If a member authorizes Senior Peace Care to communicate with a family member, caregiver, authorized representative, or other person, Senior Peace Care may do so subject to applicable privacy and authorization requirements.
Senior Peace Care may request confirmation of authorization before disclosing information.
Senior Peace Care does not automatically notify family members, caregivers, emergency contacts, or other individuals unless the member has expressly requested or authorized such communication and applicable law permits it.
Senior Peace Care is not an emergency monitoring service.
Members are responsible for maintaining the confidentiality of account credentials and other access information.
Members should notify Senior Peace Care promptly if they believe their account has been compromised.
The Services are intended primarily for adults.
Unless otherwise expressly permitted, individuals under eighteen (18) should not purchase or establish a membership without appropriate parental or legal authorization.
Senior Peace Care intends to make Services available to members within the United States, subject to operational availability.
The availability of particular Third-Party Providers may vary by ZIP code, city, county, state, service type, and other factors.
A request from a member does not guarantee that Senior Peace Care will identify a provider located within a particular distance from the member's home.
If no suitable provider is reasonably identifiable, Senior Peace Care may inform the member that it cannot fulfill the request.
Before accepting services from a Third-Party Provider, members should independently confirm:
Senior Peace Care may decline or limit requests where it reasonably believes the requested activity could create significant safety, legal, regulatory, or operational risks.
We reserve the right to recommend that a member contact an appropriate professional or emergency service instead.
Senior Peace Care may decline requests involving illegal activities, fraud, harassment, threats, dangerous activities, or services that we reasonably determine are inappropriate for the concierge program.
Members may contact Senior Peace Care regarding concerns about the Website or our Services.
Where appropriate, we may attempt to investigate or assist with a complaint.
However, we are not required to investigate or resolve disputes between members and independent Third-Party Providers.
BY USING THE WEBSITE, PURCHASING A MEMBERSHIP, CALLING SENIOR PEACE CARE, OR USING THE SERVICES, YOU ACKNOWLEDGE THAT:
